What is the difference between a 3(21) and 3(38) adviser?
Essentially, the difference between a 3(21) and a 3(38) advisor is the difference between “help me” and “do it for me.”
A 3(21) adviser is for plan sponsors that are comfortable sharing investment fiduciary responsibility and liability with the adviser. While the adviser makes investment line-up recommendations from its research, the plan sponsor is ultimately responsible for the final selection and making all line-up changes. This level of service is included with the standard service package.
A 3(38) adviser is for plan sponsors that don’t have the time or want to be responsible for the plan’s investments and shifts the responsibility (and liability) for these decisions and management to the investment adviser. This level of service is included with the premium service package.
Whether acting as a 3(21) or a 3(38) advisor, Sapling Wealth Management acts as a fiduciary for its clients.
